Terms of Service

These Terms of Service (the "Terms") govern your use of DropCheck, a web-based construction material takeoff application (the "Service"). The Service is operated by Brandon Brown (referred to as "we," "us," or "DropCheck").

1. Acceptance of Terms

By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the Service.

2. Description of the Service

DropCheck helps residential contractors, builders, and estimators generate interior finish material takeoffs (baseboard, crown, casing, stair trim, and similar items) from construction plans. DropCheck is a quantity takeoff tool. It is not a budgeting, estimating, or bidding tool, and its outputs are provided as calculation aids only. You are solely responsible for verifying every quantity before ordering materials.

3. Accounts and Authority

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • upload content you do not have the right to use;
  • attempt to defraud us, other users, or third parties;
  • send spam, malware, or otherwise interfere with the Service;
  • probe, scan, scrape, reverse engineer, or attempt to bypass security or rate limits;
  • resell, sublicense, or redistribute the Service without our written consent.

5. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Brandon Brown and is protected by intellectual property law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You retain ownership of the plans, project data, and other content you upload; you grant us a limited license to host and process that content solely to provide the Service to you.

6. Payment, Billing, and Subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, taxes, cancellations, and refunds, please also review the Paddle Buyer Terms.

DropCheck subscriptions are billed monthly at the price shown at checkout, currently $9.99/month, following a 7-day free trial. Your subscription renews automatically each month until you cancel. See our Refund Policy for details on refunds and cancellations.

7. Service Availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that any specific result will be achieved. Scheduled maintenance, third-party outages, and unforeseen issues may cause downtime.

8. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Takeoff quantities produced by DropCheck are calculation aids based on the inputs you provide, and you are responsible for verifying accuracy before use.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the 12 months preceding the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Nothing in these Terms limits liability for fraud, willful misconduct, death, or personal injury where such limitation is not permitted by law.

10. Indemnification

You agree to indemnify and hold Brandon Brown harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law.

11. Suspension and Termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time by cancelling your subscription. On termination, your right to use the Service ends; we may delete your account data after a reasonable period.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which Brandon Brown resides, without regard to conflict-of-laws principles. Courts located in that jurisdiction have exclusive venue for any dispute, except where a mandatory consumer-protection law provides otherwise.
